This website and online store are operated by Arca (“Arca,” “we,” “us,” “our”). By accessing shop-arca.com or purchasing from us (the “Site” and the “Service”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Site.

1. Eligibility

You must be the age of majority in your province/territory (or have parental/guardian consent) to use the Site and place orders.

2. Order Acceptance

Your order is an offer to buy. We may accept or reject any order for any reason, including suspected fraud, inventory or pricing errors, or violations of these Terms. If we cancel after you are charged, we will refund you.

3. Pricing, Availability & Errors

Prices, promotions, and availability are subject to change without notice. We may correct errors or omissions (including after order submission) and cancel affected orders with a refund.

4. Products & Colours

We try to display products, specifications, and colours accurately, but actual colours may vary by device. Certain items may be available online only and in limited quantities. We may limit or discontinue products at any time.

5. Shipping, Risk of Loss, Taxes & Duties

Shipping options, timelines, and fees are shown at checkout or in our Shipping Policy. Title and risk of loss pass to you when the carrier takes possession. You are responsible for any applicable taxes, duties, brokerage, or import fees unless we state otherwise at checkout. Delivery dates are estimates, not guarantees.

6. Returns & Exchanges

Returns are governed by our Return Policy (incorporated by reference). Please review it before purchasing.

7. Payments, Currency & Chargebacks

We accept the payment methods shown at checkout. Charges may appear in CAD and, if applicable, be converted by your card issuer or provider. You authorize us and our payment processors to charge your selected method for all amounts due. We may refuse, cancel, or limit orders if payment is declined or a chargeback is initiated. We may disable accounts associated with abusive dispute activity.

8. Promotions, Discounts & Gift Cards

Promotions/discounts are subject to terms posted with the offer (e.g., eligibility, duration, exclusions, single-use, non-stackable, no cash value). Launch-day management: discount codes may be temporarily suspended during product launches to manage demand and stock; codes resume thereafter under normal terms. Store gift cards (if offered) are redeemable only on the Site, not reloadable for cash (except where required by law), and subject to the terms provided at purchase.

9. Pre-Orders & Free Gifts

If you place a pre-order, we will charge your payment method at checkout unless stated otherwise and ship when inventory is available. Estimated ship dates may change. Free gifts are while supplies last, non-transferable, and have no cash value. We may substitute or cancel a free gift at our discretion.

10. Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

11. Acceptable Use

You may not: (a) use the Site for unlawful or harmful purposes; (b) circumvent security; (c) interfere with the Site’s operation; (d) scrape, crawl, or aggregate content without permission; (e) resell purchases for commercial distribution without our written consent.

12. User Content & Reviews

If you submit reviews, photos, or other content (“User Content”), you represent you own or have rights to it and that it is lawful and non-infringing. You grant Arca a worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, publish, translate, distribute, display, and create derivative works from your User Content in any media for marketing, support, and operational purposes. We may remove or refuse any User Content.

13. Third-Party Services & Links

We use third-party providers (e.g., Shopify, payment processors, shipping carriers). Your use of their services may be subject to their terms and privacy policies. We are not responsible for third-party sites or content.

14. Optional Tools

Any optional tools we provide access to are offered “as is.” Use them at your own risk and subject to the tool provider’s terms.

15. Intellectual Property

All Site content (excluding User Content) is owned by or licensed to Arca and protected by intellectual-property laws. No licenses are granted except as expressly stated.

16. Privacy & Electronic Communications

Your personal information is handled under our Privacy Policy. By creating an account, placing an order, or contacting us, you consent to receive transactional communications. Marketing emails/SMS require your express consent and are subject to applicable anti-spam laws (including Canada’s Anti-Spam Legislation). You can withdraw consent using the methods described in our messages.

17. Warranty Disclaimer

Except as required by law, the Site and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. Some provinces/territories do not allow limitations on implied warranties; those limits may not apply to you.

18. Limitation of Liability

To the fullest extent permitted by law, Arca and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or purchase of products. Our total liability for any claim will not exceed the greater of (a) the amount you paid for the product giving rise to the claim or (b) CAD $100. Some jurisdictions do not allow certain limitations; those limits may not apply to you.

19. Indemnification

You agree to indemnify and hold harmless Arca and its affiliates from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms or violation of law.

20. Export & Sanctions Compliance

You represent that you are not located in, under control of, or a national/resident of any country or entity subject to sanctions and that you will not use the Site or products in violation of export, sanctions, or trade laws.

21. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (including natural disasters, labour actions, outages, or transportation disruptions).

22. Severability & Survival

If any provision is unlawful or unenforceable, the remaining provisions remain in effect. Provisions that by their nature should survive (e.g., IP, payments, warranties, limitations, indemnities) survive termination.

23. Changes to the Site or Terms

We may update the Site and these Terms at any time. The “Effective” date shows the latest revision. Continued use after changes means you accept the updated Terms.

24. Governing Law & Venue

These Terms and any disputes are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You consent to the exclusive jurisdiction and venue of the courts in Vancouver, British Columbia. If you are a consumer in Quebec, mandatory rights under the Consumer Protection Act and language requirements may apply.
